Applicable to all courses and services provided by SmartDance
Last updated: 1 September 2026
The contracting party is Christina Brandl, Durheimerstraße 30, 94081 Fürstenzell (hereinafter “SmartDance”).
These Terms and Conditions apply to all contracts for participation in dance lessons concluded between the persons with parental responsibility for the participating children (hereinafter “parents”) and SmartDance — irrespective of whether registration is made via the website, the parent portal or on paper. Deviating arrangements apply only if they have been expressly agreed.
Registration is made using the registration form on the website or in text form. The contract is concluded when SmartDance confirms the registration in text form (e.g. by email). The term of the contract and the termination options depend on the plan chosen (§ 5).
Upon confirmation, the parents receive access to the parent portal or the parent app. There they can view course details, manage consents and receive messages from the dance instructors.
The agreed monthly fee is collected in advance at the beginning of each month by SEPA Direct Debit. We notify you of each collection in advance by email (SEPA pre-notification), stating the amount and the collection date. Please ensure that sufficient funds are available on the stated date.
Illness and absence do not release the parents from the obligation to pay the fees. In the event of a prolonged absence of more than three months, the contract may be suspended free of charge upon request.
Advance payment: Under the School Year Programme, the entire remaining programme period up to 31 August may be paid in advance in a single payment; for this we grant a discount of 5 %. The advance payment applies to the entire booked programme period. A refund in the event of early termination is made only insofar as required by law or expressly agreed.
Promotions: Advertised discounts (e.g. welcome offers for new registrations) apply exclusively to the months and groups of persons specified in the promotion. They are offset against the fees for the months concerned and shown on the statement — including in the case of advance payment.
If a direct debit cannot be honoured and the parents are responsible for this (e.g. due to insufficient funds), we charge a flat fee of €4.00 per failed debit as compensation for the bank charges incurred by us. The parents remain free to prove that no loss or a lower loss was incurred.
We notify you by email of every failed collection and every renewed collection attempt, stating the amount and the date. If the renewed attempts are also unsuccessful, the outstanding amount will be collected together with the next monthly fee.
Unilaterally reversing a direct debit does not constitute notice of termination; the obligation to pay fees continues until the contract has validly ended.
Depending on the plan chosen, the following applies:
Flex switch option (early termination of the School Year Programme): Parents may end the School Year Programme early by retroactively paying the Flex surcharge of €15 for each month remaining until the regular end of the programme. The contract then ends at the end of the month in which the declaration of the switch is received and the surcharge has been paid.
Notice of termination must be given in text form (e.g. by email to info@smartdance.de or via the parent portal); the date of receipt is decisive. Receipt and the end of the contract will be confirmed in text form.
Minor participants are deregistered by the persons with parental responsibility for them. For contracts concluded before 1 September 2026, the termination provisions agreed at the time the contract was concluded continue to apply — in particular termination at the end of the current quarter (September–November, December–February, March–May, June–August).
Lessons follow the calendar of the respective institution: no regular course lessons take place during its holidays or on public holidays. The fee is a total price spread over equal monthly instalments and already takes lesson-free periods into account.
Summer workshops: During the summer holidays, SmartDance offers weekly special workshops. Participation is included in the fee at no extra charge for all current memberships — both the School Year Programme and the Flex Plan. Dates, venues and conditions of participation will be communicated in good time. Consequently, there is no period in which fees are payable without SmartDance providing a dance offering.
Lesson times may change within reasonable limits; such a change does not constitute grounds for termination. If a lesson is cancelled for reasons for which SmartDance is responsible, the lesson will be made up or the pro-rata fee refunded.
SmartDance is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In the case of simple negligence, SmartDance is liable only for the breach of material contractual obligations, limited to the foreseeable damage typical for this type of contract.
No liability is accepted for valuables brought along. The persons with parental responsibility are liable for damage culpably caused by their child on the premises where the lessons take place.
Part of SmartDance’s service is to give parents access to impressions from lessons and performances — in particular photos and videos via the protected parent app. By concluding the contract, the persons with parental responsibility agree that photo and video recordings of their child are made during lessons and at events and are made available exclusively in the protected area of the parent app that is accessible only to the authorised parents of the respective course.
This consent may be withdrawn at any time, without giving reasons, with effect for the future — in the parent app or in text form. After withdrawal, the child will be excluded from new recordings; recordings already made available will be removed upon request. Withdrawal has no effect on participation in lessons.
Recordings from lessons are visible exclusively to the respective authorised parents and the administration — never to other parents. They are used for advertising purposes only with separate, express consent. Details are set out in the Privacy Policy.
Amendments to these Terms and Conditions will be communicated to the parents in text form at least six weeks before they are scheduled to take effect. If the parents do not object by the time the amendments take effect, the amended Terms and Conditions shall be deemed accepted; the notification will specifically draw attention to this consequence and to the right to object.
If the parents object, the contract continues on the previous terms; either party may then terminate it by ordinary notice.
Fee adjustments will be announced in text form at least six weeks in advance. In the event of an increase, the parents may terminate the contract extraordinarily with effect from the date on which the increase takes effect.
Should individual provisions of these Terms and Conditions be invalid, the remainder of the contract shall remain valid; the invalid provision shall be replaced by the statutory provisions.
